Terms and Conditions
These terms apply to all offers, orders and agreements of Hemkes Maritime B.V.. The right of withdrawal and consumer provisions apply only to customers not acting for business purposes (consumers). For business customers, article 13 applies additionally.

Article 2 — Applicability
These terms apply to every offer and every distance contract concluded. The text is made available before the contract is concluded and sent free of charge on request.
Article 3 — The offer
The offer contains a full and accurate description. Obvious errors do not bind Hemkes Maritime B.V.. Part of the range is supplied to order or made to measure; the issued quotation then applies.
Article 4 — The agreement
The agreement is concluded upon acceptance of the offer. Hemkes Maritime B.V. confirms the order electronically.
Article 5 — Right of withdrawal (consumers)
The consumer may cancel the agreement without reason within 14 days of receipt. During this period the consumer handles the product and packaging with care.
Article 6 — Exercise and costs
The consumer reports the withdrawal within the period via info@hemkesmaritiem.nl or the model form and returns the product with accessories. Return costs are for the consumer. Hemkes Maritime B.V. refunds within 14 days of notification, provided the return has been received.
Article 7 — Exclusion of the right of withdrawal
The right of withdrawal does not apply to:
- custom-made or customised products (made-to-measure cables, custom-assembled sets);
- equipment programmed or configured on request (VHF radios with ATIS/MMSI/DSC entered);
- sealed products whose seal has been broken for hygiene reasons.
Article 8 — The price
Prices are shown excluding VAT (business use); VAT for the delivery country is added at checkout. Errors excepted. For on-request products the quotation price applies.
Article 9 — Conformity and warranty
Products conform to the agreement and stated specifications. In addition to the statutory warranty, the manufacturer's warranty applies where relevant. See Warranty.
Article 10 — Delivery
Shipping costs and lead times are on Shipping. Lead times are indicative.
Article 11 — Payment
Payment via the methods offered (iDEAL and credit card via Mollie). Business customers may order on account after approval.
Article 12 — Retention of title
Delivered products remain the property of Hemkes Maritime B.V. until full payment.
Article 13 — Business customers
For business customers additionally: no right of withdrawal; warranty limited to the manufacturer's warranty; liability limited to the invoice amount, consequential damage excluded; complaints within 8 days.
Article 14 — Complaints
Complaints via info@hemkesmaritiem.nl are answered within 14 days. Consumers may use the ODR platform.
Article 15 — Applicable law
Dutch law applies exclusively to all agreements.
